1. Acceptance of Terms

By accessing or using the website and online store operated by MYAQUAPONICS (PTY) LTD (Registration Number 2013/058997/07) (“MYAQUAPONICS”, “we”, “us” or “our”), or by placing an order, you agree to be bound by these Terms of Service, our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

If you do not agree, please do not use the Services.

2. The Services

We supply aquaponics, hydroponics fish pond equipment, systems and related products. Product descriptions, prices and availability are subject to change without notice. We reserve the right to refuse or cancel any order.

3. Orders and Payment

All orders are subject to acceptance and stock availability. Prices are in South African Rand (ZAR) and include VAT where applicable. Payment must be made in full at the time of order via the methods offered at checkout. We are not responsible for delays caused by payment processors or banks.

4. Shipping and Returns

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Returns & Refunds Policy. Both policies form part of these Terms.

5. Intellectual Property

All content on the website (text, images, logos, product information, etc.) is owned by or licensed to MYAQUAPONICS and is protected by South African and international intellectual property laws. You may not copy, reproduce or use any content without our prior written consent.

6. Limitation of Liability

To the fullest extent permitted by South African law:

  • We are not liable for any indirect, incidental, special or consequential loss.
  • Our total liability for any claim arising from the use of the Services or the purchase of products is limited to the amount you paid for the relevant products.
  • Once goods have been collected by the courier, risk passes to you and we are not liable for loss or damage during transit (see Shipping Policy).

Nothing in these Terms limits any rights you may have under the Consumer Protection Act 68 of 2008.

7. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the South African courts.

8. Changes

We may update these Terms from time to time. The latest version will be posted on the website. Continued use of the Services after changes constitutes acceptance.
